Litige foncier à Ndiakhirate : Aly Salla Kane débouté face à Gora Seck
Pape Gora Seck has won another legal battle in the Ndiakhirate land dispute. The Rufisque High Court, ruling in civil matters, rejected all of Aly Salla Kane's claims, who was seeking the annulment of several land sales. In its civil judgment No. 169, issued on August 5, 2026, and delivered on September 9, the judge dismissed all of Aly Salla Kane's claims.
Aly Salla Kane was seeking, in particular, the annulment of various transactions and transfers of ownership, as well as sales made to Pape Gora Seck. The plaintiff claimed to have acquired a 27-hectare plot of land from the Seck family. He maintained that he subsequently discovered that the areas actually covered by the titles represented only 17.33 hectares. The land titles are distributed across nine titles, as follows: Nos. 2924/R, 3128/R, 21048/DP, 21051/R, 21538/R, 21164/R, 21539/R, 21163/R, and 3129/R.
329 million at stake
In response to Aly Salla Kane's claims, Pape Gora Seck presented a different version of events. He maintains that he acquired several securities directly from the plaintiff, for a total amount of 329,042,000 FCFA. To support his claim, he submitted bank statements, account details, and information relating to payments made to BHS and CBAO. According to Pape Gora Seck, the transactions were carried out with Aly Salla Kane's consent, who signed the documents knowingly.
The argument of illiteracy put forward by the latter did not convince the court either. The judges noted in particular that illiteracy cannot be presumed and that the circumstances of the case did not automatically invalidate the documents signed before a notary.
The transactions had also been carried out before the notary Ms. Binta Thiam Diop, with the formalities relating to the verification of the land status, the payment of the price, the signing of the deeds and their regularization with the competent services.
The criminal complaint did not suspend the proceedings
Aly Salla Kane also asked the court to postpone its ruling pending the outcome of a complaint filed with the Criminal Investigation Division (DIC) for breach of trust, forgery, and use of forged documents. The court held that simply filing a complaint is insufficient, in itself, to impose a stay of proceedings in a civil case. Furthermore, the plaintiff failed to demonstrate that this complaint had resulted in the actual initiation of criminal proceedings.
Ultimately, the judge rejected the stay of execution, accepted the action, but dismissed all of Aly Salla Kane's claims. The provisional enforcement order was declared moot, and the costs were ordered to be borne by the plaintiff.
