Pétrole et gaz : Présidence, Primature, ministère de tutelle, Petrosen et Cos Petrogaz, concurrence autour du…
Regarding the Yakaar-Téranga project, the Presidency, the Prime Minister's Office, the Ministry of Petroleum, Petrosen, and the Cos Petrogaz (the Petrogas Steering Committee) operated as "competing decision-making centers." This is the opinion of legal expert Insa Camara. In an interview published this Tuesday in L'Observateur, the expert recalls that "some advocated for making Petrosen the operator at all costs, while others advised a gradual approach to avoid overextending themselves."
Worse still, according to the author of *The Bet on Local Content *, this confusion led to an overreach of authority. He believes that the then-CEO of Petrosen, Alioune Guèye, "seriously exceeded his rights" by co-signing the waiver of rights and interests in the Cayar Offshore Profond block with Kosmos Energy. He cites in this regard the principle of parallelism of form, which, according to his analysis, reserved this prerogative to the signing minister.
For Insa Camara, this situation exposes the State to a double harm. On the one hand, a real loss ( damnum emergens ) linked to the contractually agreed but uncarried-out work. On the other hand, a lost opportunity ( lucrum cessans ) corresponding to the lost chance of other companies discovering hydrocarbons in the area.
