Elle laisse 580.000 euros d’héritage à sa fille, son ex-compagnon créé un faux testament pour s’en emparer
After the death of a 46-year-old woman, her ex-partner tried to recover the 580,000 euros she had bequeathed to her daughter in a will written in 2022, by presenting false documents to the court.
He tried to claim an inheritance that was not meant for him. After the death of his ex-partner, who died at the age of 46, a man presented a fake will in an attempt to seize her assets, estimated at 580,000 euros.
In 2022, the mother had indeed written a will in which she designated her daughter, then 16 years old, as the heir to all of her assets, according to the Spanish media outlet Noticias Trabajo .
After her death, however, her ex-partner presented another will, dated May 10. In this one, the daughter no longer appeared as an heir and the man was designated as the sole beneficiary of the estate.
He also claimed that he had secretly married the deceased in Cyprus in 2006. To prove it, he provided a marriage certificate supposedly issued there. These documents quickly aroused the suspicions of the woman's family.
Lawyers then contacted the Cypriot authorities to verify the existence of this union. No corresponding marriage had been registered on the date in question. Furthermore, the official who was supposed to have officiated the ceremony was not present that day.
The will presented by the former partner was also examined. A handwriting analysis concluded that the deceased's signature had likely been forged.
When questioned in court about these various points, the man failed to convince the judge. She described some of his explanations as "absurd" and "truly unbelievable."
The court ultimately concluded that the marriage certificate and will presented by the ex-partner were forgeries. The document drawn up by the deceased in 2022, which named her daughter as her heir, was therefore recognized as valid.
The man was also removed from his positions as executor of the will and administrator of the estate. He was prohibited from disposing of his ex-partner's assets and had to declare rental income from one of the deceased's properties.
He was finally ordered to pay approximately 240,000 euros in legal costs.
