Une juge américaine invalide le gel des visas imposé par Trump à 75 pays
A US federal judge on Friday declared illegal the freeze, decreed in January for 75 countries, on visa procedures allowing permanent residence in the United States, inflicting another setback on the fight against immigration sought by Donald Trump.
In her decision, Jeannette Vargas of the New York court ruled that the measure was "contrary to the law" and that it had "been taken beyond the legal powers conferred on Secretary of State" Marco Rubio.
The measure had been in effect since January 21 for immigrant visas, as opposed to non-immigrant visas which allow temporary entry into the United States, and concerned, among others, applications from nationals of Somalia, Russia, Afghanistan, Brazil, Iran, Iraq, Egypt, Nigeria, Thailand and Yemen.
According to the court ruling, the State Department believed that immigrants from these countries presented "a high risk of relying on social benefits or becoming a burden on public finances."
The decision further specifies that consular officials had been ordered to refuse immigration visas, even when they had determined that the applicant was unlikely to become a burden on public finances and otherwise met the requirements for obtaining a visa.
The decision issued on Friday overturns any visa refusal based solely on this policy.
Since returning to power, the American president has made the fight against illegal immigration a priority, massively deporting undocumented immigrants, but he has also largely restricted, sometimes draconianally, the legal entry of foreign nationals.
However, several of his key measures have been rejected by the courts.
In early June, a federal judge on Monday cancelled the $100,000 fee for work visas widely used in the technology sector.
At the end of June, the Supreme Court overturned an executive order issued by Donald Trump on the first day of his second term, abolishing birthright citizenship for children of undocumented immigrants, in an effort to end what he considered an incentive for illegal immigration.
