Propos injurieux à l’encontre de Sonko : Le verdict est tombé pour la militante de Diomaye, Khady Ndiaye
The Dakar court for flagrant offenses tried Ndeye Khady Ndiaye, a shopkeeper residing in Grand-Yoff, for making offensive remarks against Prime Minister Ousmane Sonko during a live broadcast on social media. Placed in pretrial detention on July 1st, the defendant stood by her statements.
In court, Ndeye Khady Ndiaye explained that she had created a support movement for President Bassirou Diomaye Faye about a month ago. During a live broadcast on social media, she claimed to have been targeted by internet users she described as Pastef activists, who allegedly hurled insults at her in the comments. "I made those remarks against their leader to intimidate them and force them to leave my live stream. I wanted to hurt them," she declared, bursting into tears.
The shopkeeper also claimed that her detractors had leaked her shop's address to incite others to attack her. "If I insulted them directly, they wouldn't stop. That's why I insulted their leader," she explained, before apologizing to the court and expressing her regret.
In his closing argument, the public prosecutor deemed the defendant's remarks "contrary to public morals and indecent." He requested a sentence of six months' imprisonment, three of which would be served, a fine of 250,000 FCFA, and the confiscation of the mobile phone used to disseminate the remarks.
For the defense, attorney Tafsir Abdoul Sy pleaded provocation, requesting leniency in the application of the penal code. He also asked the court to take his client's pregnancy into account when rendering its decision.
Speaking for the defense, Mr. El Hadji Diouf argued that his client had simply responded to the attacks she claimed to be suffering. "One day, I received 573 abusive calls. It was Ousmane Sonko who taught his supporters to insult people. This woman was only retaliating," he pleaded, urging the court to impose a simple warning sentence.
In its ruling, the court found Ndeye Khady Ndiaye guilty of the charges against her. However, it was more lenient than the prosecution, sentencing her to a fixed fine of 75,000 FCFA, thus avoiding her continued detention. The judges also ordered the return of her mobile phone.
