TGI Mbour : P. N. Diagne jugé pour insultes et menaces de mort présumées contre sa mère qui l'accuse de vouloir hériter de son terrain
Prosecuted for insulting and uttering death threats against his mother, A. Loum, PN Diagne denied the accusations before the Mbour High Court, despite an audio recording being presented in court. The plaintiff, who says she fears for her safety, has asked that her son leave the house. The case involves death threats, possession of marijuana, and a family dispute over real estate.
PN Diagne, 41, categorically denied threatening or insulting his mother. Regarding the marijuana, he claimed he bought it "solely to prove his mother right," as she had accused him of drug use. He also recalled that in 2019, he had experienced marital difficulties, which resulted in a two-year prison sentence. At that time, his ex-wife had insulted his mother. He had slapped her, causing her to lose eight teeth after she fell down the stairs.
This time, the dispute between him and his mother concerns a plot of land located in Saly. Mother and son are fighting over ownership. PN Diagne was preparing to build on a plot of land bearing his name, which his mother explains she bought in 1992, when her son was only 8 years old, specifying that she had registered his name on the documents at that time.
PN Diagne had a real estate project involving a foreign partner who wanted to support him in the construction of infrastructure on the said disputed land.
According to court proceedings, work had begun with the delivery of sand and concrete. The mother, having been informed, filed a complaint.
For her part, A. Loum gave a different version of events. She stated that her son had insulted and threatened her, saying, "I'm going to stab you repeatedly." Fearing for her safety, she asked him to leave her home, claiming that he was trying to inherit her property while she was still alive.
Despite the release of an audio recording in which the accused is heard uttering insults towards his mother, he continued to deny the facts.
The defense, led by Abdoulaye Tall, emphasized the deeply familial nature of the case. The lawyer argued that his client had always contributed to his family's well-being and had even stood up for his mother when she was going through difficult times.
The lawyer questioned the relevance of the videos submitted as evidence to establish the charges against his client. He argued for family reconciliation, describing the defendant as "a very sensible person" who had himself suffered from difficult situations within his family.
After debates marked by contradictory versions, the deliberation was postponed until July 21st.
