Diourbel : relaxé mais jugé dangereux, il menace le juge et se bat avec les gardes pénitentiaires
In Diourbel, ML Konté (36 years old), prosecuted for threatening his own mother with death, was acquitted. However, the court of summary jurisdiction ordered his confinement in a psychiatric institution. According to L'Observateur, which attended the hearing, the court applied Article 50 of the Penal Code, which stipulates that "there is neither punishment nor costs" when the accused is deemed mentally incapacitated at the time of the offense.
But the announcement of the verdict triggered "a scene of rare violence" in the courtroom, the newspaper reports. Beside himself with rage, the defendant clung to the bar before "insulting the judge by calling him a mother" and openly threatening to "settle the score." It took the intervention of six prison guards to subdue and remove him, "under the astonished gaze of the public."
This was not the individual's first court appearance for similar offenses, notes L'Observateur. Having already been committed to a psychiatric hospital during a previous proceeding, he had been released "following a failure in the administrative chain," without the magistrate being informed. This time, the court instructed the prefect to oversee the implementation of the measure and required semi-annual medical reports, while also ordering that "the Public Prosecutor be informed before any decision aimed at releasing the defendant."
