Mbour Criminal Court: his client acquitted after four years of detention, lawyer Abdoulaye Tall denounces “a law that is wreaking havoc”

After four years in pretrial detention, footballer S. Diouf was acquitted of rape and pedophilia charges by the criminal court in Mbour. This decision brings to an end a lengthy legal process marked by heated debates surrounding the legislation criminalizing rape.

His lawyer, Abdoulaye Tall, did not hide his indignation. In a heartfelt plea, he strongly criticized the current law:

"The criminalization of rape is very serious. It only ruins lives. This law creates victims without solving the problem. It encourages the accusation of honest people. This law is wreaking havoc," he said, announcing his intention to petition Parliament for a review of the text.

This case originated with a complaint filed in 2022 by F. Diop, accusing S. Diouf of raping his daughter, M. Ndiaye.

During the investigation and in court, the accused consistently denied the allegations. He explained that he met the young woman after she moved to his neighborhood, specifying that he never had a relationship with her.

"Her friends told me that she was in love with me. I told them that she was a child and that they shouldn't put those kinds of ideas in her head," he defended himself.

According to his statements, the young girl was sending him insistent messages, which is why he ended up blocking her on WhatsApp.

Although he claims to have blocked the contact and categorically denies any relationship, the complainant stated that she had sexual relations with the accused on three occasions, including once at his home. S. Diouf has always contested this version of events.

The prosecution noted the lack of conclusive material evidence in the proceedings. The prosecutor specifically indicated that there was no evidence to establish the existence of sexual relations between the two parties.

The defense also emphasized the inconsistencies in the case. Attorney Abdoulaye Tall pointed out that his client was in Dakar on the date of the last alleged incident, and that his statements had never wavered.

The medical certificate, for its part, mentioned an "old hymenal loss", without any direct link established with the alleged facts.

In the same vein, Mr. Rama Ba described the case as an "empty file", believing that no element could justify a conviction.

At the conclusion of the proceedings, the criminal court acquitted S. Diouf of rape, citing insufficient evidence. However, the defendant received a one-year prison sentence for abduction of a minor. This sentence has already been served, taking into account his four years of detention.

Sonko l'a échappé belle.
